Oregon revised statute ORS 446.155 states: A person may not rent, lease, sell or offer for rent, lease or sale within this state a recreational vehicle unless the recreational vehicle: (a) Bears an insignia of compliance; (b) Has previously been lawfully registered and titled within the United States; (c) Has previously been issued an ownership document under. ORS 446.571 or recorded under ORS 446.626; or (d) Is exempt from registration, title or ownership document requirements because of United States government ownership.

An Oregon Insignia of Compliance is a label placed near the primary entrance into the vehicle.  When new, the insignia is green in color and on newer vehicles the insignia may be blue in color.  Some insignia may be faded  depending on exposure. 

Inspection requests must be made by completing an Inspection and Insignia Request Application and mailing or faxing the form to the Building Codes Division prior to offering the recreational vehicle for sale.  Dealers may also schedule inspections with the Building Codes Division by calling (503) 373-7542.  Use the voice mail system to leave your name, number and a detailed message for the inspector in your area.   

To assist Oregon dealers, inspectors may visit each retail sales lot at least quarterly.

Park Trailer Disclosures  OAR 918-525-0045

The 1997 Oregon Legislative Assembly passed a bill which directly impacts your business.  The bill was Senate Bill 82, commonly referred to as the "disclosure law".  The bill requires that every dealer of a new park trailer over 8 -1/2 feet wide to present to each potential buyer a State disclosure statement for review and signature prior to any sale.  The disclosure is required to address three topics; permitted uses, wind and flood protection and snow and ice protection.  The disclosure requirements went into effect on July 1, 1998. 

Dealers and distributors shall present each potential buyer of a new park trailer with a Division disclosure statement to read and sign prior to the completion of the sales contract of any new park trailer over 8-1/2 feet wide.  Prior to presenting disclosures to potential buyers and prior to any sale, dealers and distributors shall complete the disclosure in writing indicating the date, dealer's or distributor's name, address and the Building Codes Division license number.  Dealers and distributors shall give one signed copy of the disclosure to the buyer and retain one signed copy in the dealer's and distributor's files for not less than five years from the date of sale.  Copies of signed disclosures shall be made available to the Division upon request. 

Dealers or distributors may reprint the Division's disclosure form or include the Division's disclosure statement within their own sales contract.  If a dealer or distributor prints its own disclosure, the content shall be identical to the Division's disclosure statement and shall have not less than 11 point type size.
